Vindication in the true sense of the word can be used to describe not only the outcome of a Matjhabeng Municipality security officer’s sexual harassment case, but now also her promotion that was scuttled in the process.
The South Africa Bargaining Council has found that Sellwane Agostina Mfana must be appointed to the position of security superintendent with all the benefits attached to the position. Mfana must resume her duties on 1 November.
It also found that the appointment of Manase Fanie Mothupi by the Matjhabeng Local Municipality amounts to an unfair labour practice in terms of the Labour Relations Act.
The ruling determined that he must be removed from the position of security superintendent with immediate effect and his promotion is set aside.
“I am the first woman in the top management of Matjhabeng Municipality’s security section,” says a proud Mfana.

previously reported that Mfana had experienced sexual harassment at the hands of a department head (HOD) during and after a job interview for the position she has now been appointed to.
Mfana has been working for the Matjhabeng Department of Safety and Transport for 20 years now.
She has a diploma in Criminal Justice and a diploma in Security Management, and so when a senior supervisor position in that department was advertised in 2022, she felt confident enough to apply for the job.
Her first victory was when the CCMA found in her favour, and now the Bargaining Council.
In March the CCMA had ordered the Matjhabeng Municipality to pay her compensation of R497 634 for damages.
