If an urgent court application succeeds, the provincial and national government will be compelled to intervene in Matjhabeng in terms of the Constitution by imposing a workable financial recovery plan for this beleaguered municipality.
The motion was filed by George Michalakis, DA-MP and member of the National Council of Provinces.
The premier of the Free State, Mxolisi Dukwana, as the political head of the provincial executive, is the first respondent.
The provincial government will be asked to impose a financial recovery plan for the municipality to meet its financial commitments and to provide basic services to residents.
Should it fail to implement these steps, it will either be dissolved or the provincial government will assume responsibility for the implementation of the recovery plan.
